1. About This Service
Always Watching ("the Service," "we," "us," or "our") is an independent news and information platform that aggregates, analyzes, and presents publicly available open-source intelligence (OSINT) data. We operate as an online news publication and commentary service under the protections afforded to such services by applicable law.
The Service monitors and reports on publicly available data including, but not limited to: military aircraft transponder data (ADS-B), vessel tracking information, geopolitical news and analysis, satellite imagery, and publicly available social media posts.
2. Public Data & Open Source Intelligence
All data presented on this platform is derived exclusively from publicly available sources. We do not access, intercept, or obtain any classified, restricted, proprietary, or non-public information. Our data sources include:
- Aircraft Transponder Data (ADS-B) — Automatic Dependent Surveillance-Broadcast data is transmitted unencrypted on public radio frequencies (1090 MHz) and is freely receivable by anyone with appropriate equipment. This data is aggregated by public services such as ADS-B Exchange and adsb.lol.
- News & Media Reports — Publicly published news articles, press releases, and media reports aggregated through services such as the GDELT Project.
- Satellite Imagery — Commercially and publicly available satellite imagery from sources including ESRI World Imagery and radar detection data from Global Fishing Watch.
- Social Media Posts — Publicly posted content from social media platforms, accessed through authorized APIs.
- FAA Aircraft Registry — Publicly available Federal Aviation Administration registration records linking tail numbers to registered owners.
- Commercial APIs — Publicly accessible commercial data feeds and APIs provided by third-party services.
No data on this platform requires security clearance, special access, or unauthorized methods to obtain. All information is available to any member of the public.
3. Section 230 Protection
Always Watching operates as an interactive computer service and information content provider within the meaning of Section 230 of the Communications Decency Act (47 U.S.C. § 230).
To the extent that the Service republishes, aggregates, displays, or links to content or data created or provided by third-party sources (including ADS-B transponder broadcasts, news articles, social media posts, satellite imagery providers, and government databases), the Service is protected under Section 230(c)(1), which provides that:
"No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider."
We curate, organize, and present third-party data with editorial commentary and analysis, consistent with the protections afforded to news aggregation services and online publications.
4. First Amendment Protections
The collection, analysis, and publication of publicly available information is protected speech and press activity under the First Amendment to the United States Constitution. The Supreme Court has consistently held that the press and the public have a right to publish truthful information lawfully obtained, and that this right extends to digital publications and online platforms.
Always Watching engages in journalism and public interest reporting on matters of defense, national security, and geopolitical significance — areas where public transparency and oversight are of paramount importance.
5. Aircraft & Vessel Tracking
The tracking of aircraft via ADS-B transponder data and vessels via AIS (Automatic Identification System) data is legal and constitutionally protected activity. ADS-B signals are broadcast publicly and unencrypted by design, per FAA mandate (14 CFR 91.225). Any person may receive and publish this data.
Aircraft registration and ownership information is a matter of public record maintained by the Federal Aviation Administration and is freely accessible through the FAA Aircraft Registry.
The display of aircraft owner names alongside publicly broadcast position data constitutes reporting of public facts and is protected under the First Amendment.
6. No Warranty & Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any data or analysis presented on the platform.
Data may be delayed, incomplete, or inaccurate due to the nature of the underlying sources. Aircraft may disable or spoof transponders. News reports may contain errors. Satellite imagery is subject to weather, timing, and resolution limitations.
Do not rely on this Service for any operational, safety-of-life, navigation, or time-critical decisions.
7. Limitation of Liability
To the maximum extent permitted by law, Always Watching and its operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses.
8. Intellectual Property
The original commentary, analysis, user interface design, and software code of Always Watching are the intellectual property of its creators. Third-party data displayed on the platform remains the property of its respective sources and is used in accordance with applicable terms of service, fair use, and public data doctrines.
9. User Conduct
By using this Service, you agree not to:
- Use the Service for any unlawful purpose
- Attempt to interfere with, compromise, or disrupt the Service
- Scrape, harvest, or collect data from the Service through automated means without permission
- Misrepresent the source or origin of data obtained from the Service
- Use information from the Service to stalk, harass, or endanger any individual
10. DMCA & Content Removal
If you believe that content on this platform infringes your intellectual property rights, or if you have a legitimate legal concern regarding displayed data, please contact us. We will review all requests in good faith and respond in accordance with applicable law.
11. Modifications

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.
